3. Terms of Service

These Terms of Service govern access to and purchases from Dremvu through https://nutrigeek.co.uk/. Dremvu is operated by Nexyra Health LLC, a United States limited liability company.

By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the website.

Mandatory consumer rights that cannot lawfully be excluded remain unaffected.

Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to place an order.

If you use the site on behalf of an organisation, you confirm that you have authority to bind it.

Store Use and Customer Responsibilities

You must provide accurate, current, and complete information. You are responsible for checking product details, quantities, delivery information, and the order total before payment.

You must promptly tell us if an order confirmation contains an error.

You may use the site only for lawful personal or business purchasing. You must not:

Interfere with the site or bypass security.
Introduce malicious code.
Scrape content without permission.
Impersonate another person.
Use stolen payment details.
Commit fraud.
Infringe intellectual property.
Use the site in a way that harms Dremvu, Shopify, another customer, or a third party.

Product Information

We aim to present product descriptions, images, dimensions, colours, and other information accurately.

Screen settings, manufacturing updates, and international packaging can cause minor differences that do not affect the product’s essential characteristics. A material difference, defect, or misdescription remains subject to applicable consumer law.

Products may be fulfilled by international suppliers in Asia. Packaging may differ from domestic retail packaging, and items in one order may arrive separately.

This does not reduce our responsibility to supply goods that conform to the contract.

Orders and Contract Formation

Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted.

The purchase contract is formed when we send confirmation that the order has been accepted or dispatched, depending on the wording of the confirmation sent to you.

We may refuse or cancel an order before acceptance because of:

Stock availability.
Delivery restrictions.
Suspected fraud.
Legal requirements.
Payment failure.
A manifest pricing or product-information error.

If payment has already been captured for a cancelled order, we will refund the amount paid to the original payment method.

We currently accept orders for delivery only to England, Scotland, Wales, and Northern Ireland. We may restrict quantities, products, addresses, or countries where reasonably necessary.

Prices, Currency, and Taxes

Store prices and refunds are stated in pounds sterling.

For United Kingdom orders, displayed prices include applicable import duties and import taxes under our Delivered Duty Paid arrangement. Any delivery charge is shown before the order is submitted.

If your card or account is denominated in another currency, your payment provider may apply its own exchange rate and fees.

The final amount shown on your statement may therefore differ from the store’s pounds-sterling amount. Currency differences, foreign transaction fees, and issuer charges are imposed by your provider and are not refundable by Dremvu.

Pricing Errors

If a price is manifestly incorrect, we may reject or cancel the affected order before or after an automated confirmation.

We will inform you and issue a full refund of any amount captured. We will not charge the correct price without obtaining your agreement.

Payment

You authorise the amount shown at checkout to be charged through the available payment method.

Payment services may conduct verification and fraud checks. We do not guarantee that any particular payment method will remain available.

Delivery

Processing and delivery estimates are explained in our Shipping Policy.

Estimates may be affected by international carriers, weather, operational disruption, and other events outside our reasonable control. An estimate is not a guaranteed delivery date unless we expressly agree to a specific date.

Risk of loss remains with us until the goods come into your physical possession or that of a person you nominated, except where you independently arrange a carrier that we did not offer.

Legal rights for late or failed delivery remain unaffected.

Cancellations, Returns, and Refunds

Our Refund and Return Policy forms part of these Terms. It provides a 14-day cancellation standard and separate remedies for faulty goods.

Where that policy conflicts with mandatory consumer law, mandatory law prevails.

Intellectual Property

The website and its content, including text, graphics, product presentation, logos, images, design, and software, are owned by or licensed to Nexyra Health LLC and are protected by applicable intellectual-property laws.

You may use the site for personal shopping and may keep copies of order records. No other licence is granted.

You must not reproduce, distribute, modify, sell, or exploit protected content without written permission or a legal right to do so.

Third-party names and marks belong to their respective owners.

Reviews and Content You Submit

You must have the right to submit any review, image, or other content you provide. It must be accurate, lawful, and must not violate another person’s privacy or intellectual property.

You grant Nexyra Health LLC a non-exclusive, worldwide, royalty-free licence to host, reproduce, and display that content for operating and promoting the store, subject to applicable privacy law.

We may remove unlawful, fraudulent, abusive, or irrelevant content.

Third-Party Services and Links

Shopify and other service providers help operate the store. External websites and services are controlled by their operators.

Links do not amount to an endorsement, and we are not responsible for external content or practices. This clause does not exclude responsibility that the law places on us.

Disclaimers

We do not promise that the website will always be uninterrupted or error-free. We may suspend access for security, maintenance, or operational reasons.

Product-specific promises are only those stated in the product description, order confirmation, these Terms, or required by law.

Nothing in these Terms excludes statutory guarantees, satisfactory-quality requirements, fitness-for-purpose obligations, or other rights that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by the law of your country of residence, Nexyra Health LLC is not liable for indirect or unforeseeable loss, loss that was not caused by our breach, or business loss arising from a consumer purchase.

We remain responsible for loss that is a foreseeable result of our breach or failure to use reasonable care and skill.

Nothing in these Terms limits or excludes liability for:

Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Defective products where liability cannot be excluded.
Breach of mandatory consumer rights.
Any other liability that cannot lawfully be limited.

Events Outside Reasonable Control

We are not responsible for delay caused by an event outside our reasonable control, but we will take reasonable steps to reduce its effect and inform affected customers where appropriate.

This clause does not remove rights to cancel or obtain a refund when the law provides them.

Changes to the Website and These Terms

We may update the website and these Terms for future use to reflect legal, security, operational, or service changes.

The version in force when you placed an order will ordinarily govern that order. Material changes will not be applied retroactively where doing so would unfairly reduce an existing right.

Governing Law and Courts

These Terms and non-contractual matters are governed by the laws applicable in the State of Colorado, United States, without regard to conflict-of-law rules.

If you are a consumer in the United Kingdom, this choice does not deprive you of mandatory protections provided by the law of the part of the United Kingdom where you reside.

You may bring a claim in any court available to you under mandatory consumer law. Subject to those rights, the competent state and federal courts in Colorado have non-exclusive jurisdiction.
